PENAL CODE ADOPTION DOESN'T DRAW NEARER TO CAPITAL PUNISHMENT ABOLISHMENT

Armenian Government and Parliamentary Commission on state and law issues are going to complete to work out the Penal Code bill. Death penalty is replaced with life sentence in the bill.

The head of Commission Victor Dallakyan says there is a proviso in the bill, that the Penal Code would take force as a separate law. It means the law on death penalty abolishment is to be adopted, however, when exactly it will be put in force MPs are going to decide by adopting one law more.

Dallakyan says he will reject the initiative if the problems connecting with death penalty arise at October 27 terrorist action proceedings. “We have found a version admitting death penalty application in case of terrorist action in Parliament”, he says.

Viktor Dallakyan says he doesn’t want to reveal details to avoid affecting the process. On the other hand, he is ready to explain to the monitoring group of the Council of Europe why the Armenian National Assembly delays the death penalty abolishing. The thing is that the head of the State Law Commission refers to the 2nd item of the Constitution, according to which People execute power by means of rallies, elections, elective and nominative bodies. Hence the Parliament, being the body elected by people, can decide to enforce the new law, for example, from 2005.
