IT WILL BE SUCCESS IF "A1+" CASE IS HEARD WITHIN 2 YEARS
Support A1+! “2 years are good term for hearing “A1+” case in European Court ” ,- Tigran Ter-Yesayan, “A1+” barrister as well as Chair of International Union of Armenian Advocates says.
He arrived at a conclusion taking into account the terms for cases before the Court – 7 years. A case is brought for consideration within 3 months and each phase lasts rather long.
The members of British Advocates’ Union are in Armenia. Today they met Armenian advocates and introduced the order for appealing to European Court. They also dwelt on ceremonial regulations. Armenian advocates wondered if it is necessary to introduce the whole of a case for consideration in European Court . “European Court is interested only in the decision of the last instance and case introduction with serious substantiation” ,- Deklan O’ Kalahan, member of British Advocates’ Union says.
The next point advocates were interested in was - is it possible to appeal to 2 Courts simultaneously – European Court and UNO’s one. O’ Kalahan says it is possible but it will weaken an applicant’ s stances .
If death penalty European Court can delay verdict execution till the end of a case consideration. Mr O’ Kalahan regards it right as people are often sentenced to death because of non-objective consideration of a case.
