WHETHER JUDGE DISPLAYED BIASED APPROACH?

Six months ago, A1+ TV Company filed a suit to the Economic Court against Radio and Television National Commission demanding the commission to present justifications for its decision, according to which A1+ had been denied broadcasting license.

However, no justifications have been presented by the commission so far. It is obvious, that the commission has no intention to do that in the near future and will repeatedly plead to the court with strange and unnecessary motions in an apparent attempt to prolong the legal proceedings.

Simultaneously, he court is considering the company’s two other suits – the first is related to license for broadcasting on 25 UHF and the second to 31, 39 and 51 UHF. Taking into account that the suits have much in common, the court combined them into one.

The defendant attorney pleaded to the court on February 10 asking to consider the cases separately. The court denied the motion. Then, defense attorney filed another motion demanding to relieve the judge from duty because of his “biased approach”.

This is the second motion demanding the judge’s suspension. Previous one has been denied. This time the demand was satisfied.
