What does the Harsnakar case have to do with MD?
Presses continue to discuss the issue of transferring the criminal case in relation to the crime committed at Harsnakar Restaurant Complex from one department to the next.
"A1+" asked press speaker of the RA Prosecutor General's Office Sona Truzyan why the Prosecutor General decided to send the case that was sent to the Ministry of Defense back to the RA Police.
"After studying the decision on sending the criminal case in relation to the crime committed at Harsnakar Restaurant Complex to the investigative department, which was taken by the preliminary investigative body (investigative department of Nor Nork), the Prosecutor General's Office found that there were no grounds to send the case to the Ministry of Defense," Sona Truzyan told "A1+".
Truzyan went into the details and informed that Article 190 (5) of the RA Criminal Procedure Code clearly establishes the cases that can be investigated by MD investigators. According to that point in the Code, the Ministry of Defense can investigate the crimes that are against the procedure of military service, have been committed in the territory of the military unit, or the crimes that are ascribed to persons providing services for the MD authorized body and within MD organizations.
The crime in relation to the incident that took place at Harsnakar Restaurant Complex wasn't against the procedure of military service, wasn't committed in the territory of a military unit and lacks sufficient grounds stating that the crime was committed by military servicemen.
Vahe Avetyan and Artak Bayadyan had been recognized as victims in the preliminary investigation stage. They were in extremely critical condition and couldn't participate in the investigation. This means that the doctors, according to the materials obtained, had the status of victims and the Ministry of Defense couldn't lead an investigation into the case. That is why the Prosecutor General assigned to send the case back to the RA Police for preliminary investigation," said Sona Truzyan.
According to her, the Prosecutor General's Office has worked within the limits of its powers as a supervising authority and hasn't allowed any violation of the Criminal Procedure Code.
We remind that there are already 7 arrested. They are all employees of Harsnakar Restaurant Complex, including manager David Hayiryan, waiter David Adamyan, security officers Artur Babloyan, Garik Margaryan, Arman Khachatryan and Arman Baghdasaryan.
Military doctors Artak Bayadyan, Gagik Soghomonyan, Vahe Avetyan, whose condition is still extremely critical, as well as civilians Edgar Nikoyan and Arkadi Aghajanyan were injured and transferred to the hospital in critical condition.
