Vahe Grigoryan wins in European Court
The European Court of Human Rights has upheld lawyer Vahe Grigoryan's claim against the Republic of Armenia (CASE OF GRIGORYAN v. ARMENIA Application no. 3627/06). The Armenian government must pay Vahe Grigoryan 2,500 Euros.
Vahe Grigoryan, who was the lawyer for the residents expelled from their homes on Buzand Street for state needs, was arrested under the charge of fraud and falsification of documents on October 7, 2005.
On October 10, the court chose arrest as a measure of restraint. The Appeals Court left the first instance court's ruling unchanged, and then the arrest was extended for two months.
The European Court has found that the application of arrest against Vahe Grigoryan violates Article 5 (1) ("right to freedom") and Article 5 (6) ("fair trial") of the European Convention.
