Armenian Ombudsman challenges constitutionality of law
The recent amendments to the RA Law on State Pensions have considerably aggravated the condition of pensioners as compared with the previous law, Armenian Ombudsman's Office said in a statement.
Under the new provisions, after calculating pension, a pensioner receives less money than in the past. In particular, a pensioner is paid for a shorter period without receiving pension over years for different reasons. For example, if earlier, a citizen was paid for three years, today he is paid for one year.
By another provision, the right to receive partial pension has been restricted, with changes being introduced in the calculation of employment history periods as well.
Article 42 of the RA Constitution envisages that laws and legal acts worsening a person's legal status do not have a retroactive effect. This is also enshrined in a number of international documents, including the case-law of the European Court of Human Rights.
Thus, concerned with the problems of pensioners, based on the provisions of the Constitution, decisions of the RA Constitutional Court and requirements of the international law, Armenian Ombudsman Karen Andreasyan is disputing the constitutionality of the law worsening the condition of pensioners.
