NO CHANCE TO COMPLAIN IN THE CONSTITUTIONAL COURT

The RA Government has violated a number of articles of the Orhus Convention which our country signed in 2001. This assessment was given by the Orhus corresponding committee on April 7 of the current year while investigating the application about the appropriation of the Dalma gardens.

NGOs “Armenian Botanic Company”, “Center for Regional Development” and “Armenian Center of Protection of Human Rights after Sakharov” applied to the Committee in 2004 complaining about the five decisions made by the RA Government about the area. The Committee has certified that several articles of the Convention have been violated and has sent an offer to the Government about mending the violations.

In 2004 the organizations applied to the Courts of the First Instance of the Kentron and Norq-Marash communities demanding to announce the Government decisions invalid as they violate not only the articles of the Orhus Convention, but also those of the Land Code and several other laws. But the applications were turned down both by the Court of the First Instance and by the Court of Appeal.

On May 10 the NGOs will hold a discussion with the members of the Government. Asked the question if the NGOs will appeal the anti-constitutional decisions in the Constitutional court, lawyer Mary Khachatryan answered, “We do not know what applications can be sent to the Constitutional Court. We will learn everything after the Law on the Constitutional Court is amended.”
