JUDGES SHOULD ALSO BEHAVE PROPERLY

Judges may apply sanctions to people who participate in court proceedings or in court sittings and treat the court with disregard, hamper the regular judicial procedure, use their judicial rights unconscientiously and do not fulfill the judicial commitments.

From 4 judicial sanctions applied against prosecutors and lawyers since 7 April 2007, two included a precautionary sanction and submitting an appeal to a prosecutor's office or the Chamber of Advocates for them to present the cause. Ara Zohrabyan, chairman of the Chamber of Advocates of the Republic of Armenia said the Chamber of Advocates had received three similar mediations since 7 April: one from the First Instance Court of Erebuni and Nubarashen Communities, and two from the RA Civil Appeal Court. The Chamber tried to determine whether the judges used their authority conscientiously or tried to frighten the lawyer.

The Council of Advocates declined the disciplinary appeal against Hovik Arsenyan and Vardan Safaryan taking into account the mediations for the lack of evidence. Moreover, investigating the judicial records of the latter, the following was registered: ''The judge shouted at the lawyer, and invited him out which is considered to be an illegal step'', said Ara Zohrabyan.

The Chamber decided to submit an appeal to the Disciplinary Commission of the RA Judicial Council and the RA Minister of Justice against the RA Civil Appeal Court Judge Tigran Sahakyan.

The Chamber of Advocates confirmed that the Judge of Erebuni and Nubarashen Communities intended to put pressure on the lawyer.

''Chamber of Advocates anticipates proper behavior from the judges'', said Ara Zohrabyan.

In the future the lawyers will organize a discussion with the concerned parties.
