THE ILLEGAL ACTIONS BY TELEVISION NETWORK OF ARMENIA WERE AGAIN JUSTIFIED

Today the Chamber of Civic and Economic Cases of the Court of Appeal again justified the illegal actions by "Televion Network of Armenia" State CJSC .

Let's remind that on April the 2-nd, at 12:01 AM the employees of TNA switched off the transmitter of "A1+" TV Company. It was situated in the territory of TNA on lease.

Under the treaty concluded between "A1+" and TNA, problems appeared must be solved through the Armenian Legislation. And there was a problem. TNA appealed to "Meltex" Company with the requirement to stop the broadcasting of the transmitter. The requirement was not satisfied by "Meltex", as a company is given a day-long term after being deprived of licence. Disregarding the term, TNA switched off the transmitter, whereas it was to appeal to the court instances under the law if "Meltex" didn't satisfy the demand within a day .

The document N 92 by TV and Radio National Commission was as a base for TNA to switch off the transmitter of "A1+". Through the document TV and Radio National Commission demanded TNA to stop "A1+" broadcasting. By the way, the Commission had no right to demand something like that under the Legislation of Armenia . This was approved by the Economic Court of Armenia as well on April the 3-rd.

During the hearing of the claim in the Economic Court the representatives of TNA announced they had been guided by the letter of the Vice-Minister of Communication and Transport of Armenia, that is, to stop broadcasting of "A1+" TV.

But the decision was made on April the 6-th and the transmitter was switched off on April the 3-rd. These outrages committed were disregarded by the Court of Appeal .
