GAGIK HARUTYUNYAN IS HORRIFIED
Support A1+!Today Gagik Harutyunyan, Chairman of Constitutional Court held a press conference, at which he announced that under CC decision, Stepan Demirchyan’s application was ignored. By the same decision, it was stated “Armenian president was elected by election results” , Harutyunyan said.
He announced if the dubious votes for the winning candidate were added to the votes of the other, “they would have no impact” .
Why did CC choose the version of “leaving unchanged CEC March 11 decision” and didn’t recognise as valid the election results in its decision? The reason is that CC has no criteria for settling such quarrels under the Law on CC.
Gagik Harutyunyan has talked about the solution variants with the Europeans. He understood the main peculiarity of Demirchyan’s application is that there is problem of infringement of not only active right but also the passive one.
“In other words, the right for being elected was broken” , Harutyunyan clarified.
The next feature was that the qualitative character of irregularities was stressed at the application. Harutyunyan has concluded that “both aspects must be at the centre of attention” . So CC left unchanged CEC decision and not declared valid the election results. And what about the “referendum of trust”? CC Chair says some people disputed the phrase, even became “specialists of right within a day” .
“If the political resistance has turned into the social one, there are solutions. “Referendum of trust” is namely that solution” , Harutyunyan says. “We formulated clearly though election breaches were not much, they caused concern ” .
Today Harutyunyan announced that “referendum of trust” is a suggestion and has no juridical consequences. He dispelled doubts of Authorities on that CC expressed distrust to Robert Kocharyan.
